What This Privacy Policy Covers

This policy covers how PROMPICKER treats personal information that PROMPICKER collects and receives, including information related to your past use of PROMPICKER products and services. Personal information is information about you that is personally identifiable like name, address, email address, birth date, phone number, school/college and that is not otherwise publicly available.

Information Collection and Use

PROMPICKER collects personal information when you register with us or add the PROMPICKER application for Facebook, when you use PROMPICKER products or services, when you visit PROMPICKER pages or the pages of certain PROMPICKER partners. When you register with PROMPICKER and sign in to our services, you are not anonymous to us.

When you use PROMPICKER, you may set up your school’s prom page, form relationships, send messages, send virtual gifts, upload files and photos, perform searches and queries, form groups, set up events, and transmit information through various channels. We collect this information so that we can provide you the service and offer personalized features.

When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.

You post content on the Site at your own risk. Please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages or if other Users have copied or stored your User Content.

PROMPICKER strives to provide notifications to users of relevant content in a timely manner but is not responsible for lost or late notifications

PROMPICKER automatically receives and records information on our server logs from your browser, PROMPICKER cookie information, and the pages you request.

PROMPICKER uses information for the following general purposes: to customize the advertising and content you see, fulfil your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting.

Information Sharing and Disclosure

PROMPICKER does not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services you've requested, when we have your permission, or under the following circumstances:

  • We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
  • We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of PROMPICKER's terms of use, or as otherwise required by law.
  • We transfer information about you if PROMPICKER is acquired by or merged with another company. In this event, PROMPICKER will notify you before information about you is transferred and becomes subject to a different privacy policy.

PROMPICKER displays targeted advertisements based on personal information. Advertisers (including ad serving companies) may assume that people who interact with, view, or click targeted ads meet the targeting criteria for example, girls aged 16-19 from a particular geographic area.

PROMPICKER does not provide any personal information to the advertiser when you interact with or view a targeted ad. However, by interacting with or viewing an ad you are consenting to the possibility that the advertiser will make the assumption that you meet the targeting criteria used to display the ad.

PROMPICKER may send you service-related announcements from time to time through the general operation of the service. For instance, if a friend or classmate selects you as a potential date on PROM PICKER you may receive an email alerting you to that fact.

Generally, you may opt out of such emails by clicking the opt out link in the footer of each email, though PROMPICKER reserves the right to send you notice about your account even if you opt out of all voluntary email notifications.

Children Under Age 13

PROMPICKER does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to use PROM PICKER or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on PROMPICKER. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible.

Children Between the Ages of 13 and 18

We strongly recommend that minors ask their parents for permission before sending any information about themselves to anyone over the Internet.

PROMPICKER may set and access PROMPICKER cookies on your computer.

PROMPICKER lets other companies that show advertisements on some of our pages set and access their cookies on your computer. Other companies' use of their cookies is subject to their own privacy policies, not this one. Advertisers or other companies do not have access to PROMPICKER's cookies.

Your use of PROMPICKER, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Use and all of its dispute resolution provisions including arbitration, limitation on damages and choice of law.

Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on this site. If we make changes, we will post them and will indicate at the top of this page the policy's new effective date.
